Congressman Cohen is Preparing a Censure Resolution over Justice Alito’s Flagrant Violation of Judicial Impartiality and Ethics Violation

WASHINGTON – Congressman Steve Cohen (TN-9), a senior member of the Judiciary Committee, is preparing to introduce a resolution of censure against Justice Samuel Alito for publicly flying the American flag upside-down, a commonly understood symbol of the “Stop the Steal” effort which falsely claimed Donald Trump won the 2020 Election.  This expression of political support for Donald Trump and opposition to Joe Biden publicly demonstrates Justice Alito’s political bias and constitutes a serious breach of judicial ethics.

Congressman Cohen made the following statement:

“I read with revulsion about Justice Alito’s desecration of our national symbol. The disrespect shown to the American flag flying in front of his Virginia home days after the January 6, 2021, assault on the U.S. Capitol shows his allegiance to the baseless belief that Trump won the 2020 election. He should be censured. It also demonstrates that he is politically biased and must recuse himself from every case regarding the 2020 election and the subsequent coup to overturn the election.  Anything less would further demonstrate Justice Alito’s disdain for the impartial administration of justice and the rule of law, and would be a stain on the United States Supreme Court.”

The House is currently not in session but Congressman Cohen plans to introduce the measure when it reconvenes next week.
