Congressman Cohen Questions Special Counsel Robert K. Hur

March 12, 2024

Says “you declined to prosecute because you found insufficient evidence of a crime”

WASHINGTON – Congressman Steve Cohen (TN-9), a senior member of the Judiciary Committee, today questioned Special Counsel Robert K. Hur, who exonerated President Biden of criminally mishandling classified information after serving as Vice President.

After describing President Biden’s proactive cooperation with investigators and noting that Hur was a former political appointee of former President Donald Trump, Congressman Cohen said, “You declined to prosecute because you found insufficient evidence of a crime. Case closed.”

In his response to Congressman Cohen’s questions, Hur testified that Attorney General provided Hur’s office with the appropriate resources and empowered him to conduct independent investigation, free of any interference.

Toward the end of his questioning, Congressman Cohen noted that some Republicans have made an issue of what Hur wrote about Biden’s memory. Congressman Cohen said:

“I appears to me, and I think it would appear to the American public, that these minor discrepancies as far as dates, and after a long period of time, was not the basis for your decision not to prosecute him. It was the fact that you didn’t have the facts: He acted differently than Trump. He voluntarily provided the documents and complied with the Justice Department. He didn’t try to obstruct justice…

“To be president, you have to have values. You have to have an understanding of what values America has and needs to maintain to keep the world safe and peaceful. That’s dealing with Ukraine. That’s dealing with difficult people like (Benjamin) Netanyahu in Israel and trying to get something done that’s correct. That’s what Joe Biden does.”

Congressman Cohen also objected to Congressman Matt Gaetz’s portrayal of President Biden and many seniors with occasional memory loss as “senile.”  Those characterizations are both offensive and untrue.  Later in the hearing, Hur also rejected that characterization.
